課程概述

刑事訴訟法乃法律系學生必修之基礎科目，在國家考試上亦佔有一席之地，對於學生畢業後可能從事之檢察官、法官或律師業務尤為重要。由於刑事訴訟法最近歷經多次大幅修法，並且幾年來之學說創新，以傳統領域與新的發展併陳的結果，致使教學範圍相當龐大。本課程設計之教學著重於重要新興議題與立法新制，以結合理論與實用。

Criminal procedural law is a basic subject that students of Law Department have to study; furthermore, it is also an important subject of national law examinations. And for prosecutors, judges and lawyers, it is also essential to perform their duties with sufficient legal profession. As the legislation had been substantially amended and revised, the contents of the course have been expanded. The course will focus on new topics and legislations of Taiwanese criminal proceedings. 

課程目標
 本課程教學設計以培養學生刑事訴訟之基本觀念為主，但為拓展學生進一步思考刑事訴訟相關問題之空間，訓練學生未來執業時獨立解決問題之能力，教學範圍除注重我國立法、裁判與學說外外，將兼及外國之學說、判例與立法例，並以報告、討論討論方式進行。
The course is designed to train participants to have basic concept of criminal procedural law. For the purpose of enforcing the capability of thinking and dealing with problems independently, we will also introduce foreign doctrines, legal precedents and legislation. 
課程要求
 本課程進行方式，如其他研究所課程，由修課同學擔任報告主軸。修課同學需挑選一子題言詞報告，事先一星期並應提出書面報告，此外，所有修課同學有出席義務及參與討論義務，列入評分項目。
外文資料以英文或德文為主，因各報告主題有別、文獻不同，無法事先一一列舉，僅例示如下之參考文獻。
As far as the seminar is concerned, all participants are required to make an oral presentation and submit a written-form assignment in advance. Furthermore, attendance and discussions are both essential to the course, therefore, those who are unable to meet the requirements and absent from classes for more than two times will be graded as disqualification. Please deliberate whether or not you can comply with above conditions before taking the course.

原則上以口頭報告、期末書面作為評分基準。學生上課的參與表現將作為評分參考依據。
